Each state has its own set of timelines for filing personal injury and wrongful death lawsuits known as statutes of limitations. The statute of limitations for a mesothelioma personal injury lawsuit is based on the date of an asbestos-related diagnosis. The statute of limitations for a wrongful death lawsuit is based on the victim’s date of death. It is important to speak with a mesothelioma lawyer familiar with Rhode Island law to understand the applicable statutes of limitations for each case.

Statutes of Limitations for Pawtucket
Personal Injury

Claims must be filed within 3 years after an asbestos-related diagnosis.

Wrongful Death

Claims must be filed within 3 years after an asbestos-related death.

Once the statutes of limitations have expired, neither the injured party nor their family will be able to file a lawsuit against the responsible parties. To help ensure this does not happen, mesothelioma victims should retain an experienced mesothelioma law firm as soon as possible after a diagnosis.

Depending on where past asbestos exposure occurred, there may be other states that are more advantageous in which to file a lawsuit. Other states may have different applicable statutes of limitations. This can all be discussed with an experienced attorney.

Asbestos in Pawtucket, Rhode Island

Industries in Pawtucket may have led to asbestos exposure for Rhode Island workers and residents. Pawtucket was once a national leader in the textile industry, where asbestos was used frequently. Asbestos was also frequently found in construction products used in buildings, homes and schools. For example, the Pawtucket City Hall underwent asbestos remediation in 2018. However, the textile mills and plants of Pawtucket remain the most notable asbestos exposure sites in the city.

Asbestos in Textile Mills in Pawtucket, Rhode Island

Pawtucket was once a hub for textile production and was home to the historic Slater Mill. The Slater Mill, established in the 1700s, was the first water-powered textile mill in North America. From there, Pawtucket would become a center for textile production until the 20th century. The Slater Mill and other textile mills in Pawtucket used asbestos in their processes. Workers at these mills were exposed to the mineral frequently while producing asbestos textiles.

Asbestos was spun into yarns and threads to make cloth. This created large quantities of asbestos dust that textile workers would breathe in. The machines in the mills also contained asbestos components and many mills were built with asbestos materials.

As a result, textile mill workers were at high risk for asbestos exposure.

After many of these old mills were closed down, they were repurposed for residential and commercial space. As a result, Pawtucket residents, construction workers and other tradesmen who lived in and worked on these buildings may have been exposed to asbestos materials.
