New Jersey Asbestos and Mesothelioma Laws

Several New Jersey administrative departments oversee various aspects of the state’s asbestos codes, including the Department of Environmental Protection (asbestos management, transportation, and disposal), the Department of Labor (asbestos abatement and licensing), and the Department of Community Affairs (asbestos certifications).

Asbestos Abatement and Licensing in New Jersey

Enforcement of the Asbestos Control and Licensing Act falls under the purview of the New Jersey Department of Labor (DOL), as it applies to all buildings in the state (private, public, commercial, and residential). In general, the Department of Labor investigates illegal asbestos abatement activities and the improper handling or disposal of asbestos. The DOL also licenses asbestos abatement contractors and issues permits to the asbestos workers and supervisors employed by those contractors. Asbestos abatement in schools is overseen by the New Jersey Department of Health. Both agencies run asbestos operations from their main offices in Trenton.

Asbestos Transportation and Disposal in New Jersey

New Jersey has a strict set of requirements for transporting and disposing of asbestos and asbestos-containing materials within the state. According to the New Jersey Solid and Hazardous Waste Management Program, when transporting any materials containing asbestos, those materials must be “adequately wet” so that asbestos particles do not fly into the air. Asbestos materials must also be bagged or otherwise sealed in bulk shipping containers at least 6 millimeters thick for transport and disposal. Only properly registered solid waste vehicles are allowed to transport asbestos within the state, and disposal is allowed only at landfills or transfer stations that are permitted to receive asbestos materials.
